Regulatory Jurisdiction
Depending on the intended market for your product, technology or software, different U.S. government agencies may exercise regulatory jurisdiction, including issuing licenses when necessary. These agencies can vary from the Bureau of Industry and Security for “dual use” items to the Department of State’s Directorate of Defense Trade Controls for military items and, for nuclear items, either the Nuclear Regulatory Commission or the Department of Energy. Knowing the correct regulatory agency is the most important element of assuring a successful compliance program. compLight, LLC has the expertise to assist with these jurisdiction determinations as well as to train staff and develop procedures to assure the proper jurisdictions are recognized.
Classification
All products, whether exported or imported, must be classified under one or more schema. For exports, these classifications depend, in part, on the regulatory agency exercising jurisdiction. For both exports and imports, the Harmonized Tariff System must be utilized. compLight, LLC will provide the expertise to properly classify all exports and/or imports to assure proper reporting of these activities as well as correct duties payments.
Policies and Procedures
No International Trade Compliance program can be effective without documented policies and procedures to assure all employees understand their role and the regulations that apply to their job. Development of effective procedures requires both a detailed knowledge of the regulations and an ability to effectively and efficiently implement procedures that will help assure compliance without disrupting the company's operations. compLight, LLC has the background in the regulations as well as operating requirements to implement an effective program.
Training
compLight, LLC has the ability to train in all facets of the regulations. Training materials are available that are suitable to all levels of the organization, from high-level overviews for senior management to detailed training for the compliance staff and operating personnel. Training includes exercises to reinforce the subject matter and can be tailored to the company's specific needs and requirements.
Transaction Screening
Various government agencies maintain lists of countries, individuals, companies and other organizations with which U.S. companies are restricted from doing business. A critical element of any successful compliance program is effective screening to assure that such transactions do not occur, or that the appropriate export authorization is secured if the transaction is permissible. compLight, LLC has significant experience in developing these procedures and assisting in preparation of license applications when required.
Audits and Assessments
An effective compliance program not only requires documented procedures and trained personnel, but constant monitoring to be certain that the procedures are working. All government agencies see this as a critical element of any effective program, and compLight, LLC can conduct assessments and audits that will assist in identifying any weaknesses in the program as well as propose improvements to make the compliance program even more effective.
